Terms and Conditions of the unitracing.pl Online Store
Valid from 28 July 2025.
§ 1. Definitions
The terms used in these regulations mean:

Seller – Michał Wasilewski, running a business under the name Unit Racing Michał Wasilewski, with its registered office at ul. Rynkowa 1, 05-270 Marki, NIP: 5241913319, REGON: 141836752.

Store – online store run by the Seller at www.unitracing.pl.

Client – a natural person, legal person or organizational unit without legal personality who makes purchases in the Store.

Consumer – A Customer who is a natural person and who enters into a legal transaction with the Seller that is not directly related to his or her business or professional activity.

An entrepreneur with consumer rights – a natural person conducting business activity, concluding a contract with the Seller directly related to his/her business activity, but the content of this contract indicates that it is not of a professional nature for him/her, resulting in particular from the subject of his/her business activity (PKD).

Statute – this document defining the terms and conditions of using the Store and concluding sales contracts.

Sales Agreement – a contract for the sale of Goods concluded between the Customer and the Seller via the Store.

Commodity – a movable item available in the Store’s offer, which is the subject of the Sales Agreement.

Working day – one day from Monday to Friday, excluding public holidays.
§ 2. General provisions and contact details

The Terms and Conditions define the rules for placing orders, concluding sales agreements, as well as the rights and obligations of the Parties. The Terms and Conditions are available free of charge on the Store's website in a form that allows for downloading, saving, and printing.

To use the Store, including browsing the product range and placing orders, you must:

A device with Internet access.

A current web browser (e.g. Chrome, Firefox, Safari, Edge).

§ 3. Placing orders and concluding a contract

Orders can be placed in the Store 24 hours a day, 7 days a week, via the order form available on the Store's website.

To place an order, the Customer selects the Goods by adding them to the basket, and then provides the data necessary to complete the order (name and surname, address, e-mail address, telephone number) and selects the delivery and payment method.

A necessary condition for placing an order is to read and accept these Regulations and the Privacy Policy, which the Customer confirms by checking the appropriate box before finalizing the order.

Information about the Goods provided on the Store's website constitutes an invitation to enter into a contract within the meaning of Article 71 of the Civil Code. Placing an order by the Customer constitutes an offer to enter into a Sales Agreement.

The Sales Agreement is deemed to be concluded when the Customer receives an e-mail from the Seller confirming acceptance of the order for execution.
§ 4. Prices and promotions (compliance with the Omnibus Directive)

All prices listed in the Store are gross prices (including VAT) and are expressed in Polish zloty (PLN).

Prices do not include delivery costs, which are provided separately when placing the order.

In the event of announcing a price reduction for the Goods (promotion), next to the promotional price the Seller also provides information about the lowest price of this Product that was valid in the period of 30 days before the introduction of the discount.

The price binding on the Parties is the price displayed next to the Goods at the time the Customer places the order.
§ 5. Payment and Delivery

The customer can choose one of the following payment methods:

Online payment via Paynow.

Other payment methods, if available on the order form.

The entity providing online payment services for card payments is mElements SA

Order processing begins after the payment is credited to the Seller’s account or after receiving confirmation of correct payment from the operator.

Delivery is available within the territory of the Republic of Poland. Detailed information about available delivery methods, costs, and times can be found on the dedicated "Payment and Delivery Methods" subpage.
§ 6. Right of withdrawal

The Customer who is a Consumer and the Entrepreneur with consumer rights has the right to withdraw from the Sales Agreement concluded at a distance within the period 14 days without giving a reason.

The period for withdrawal from the contract begins on the date the Customer or a third party indicated by him takes possession of the Goods.

In order to exercise the right of withdrawal, the Customer must inform the Seller of his/her decision by means of an unequivocal statement (e.g. a letter sent by post or e-mail to the contact details provided in § 2).

The Customer bears the direct costs of returning the Goods.
-

§ 7. Complaints (Warranty and Guarantee)

The Seller is obliged to deliver to the Customer the Goods free from physical and legal defects (warranty).

If the Goods are defective, the Customer may submit a complaint and request:
-
replacement of the Goods with a new one,
-
repair of the Goods,
-
price reduction,
-
withdrawal from the contract (if the defect is significant).

Complaints should be submitted in writing or by e-mail to the addresses given in § 2 of the Regulations, providing a description of the defect, the date it was discovered and your request.

The seller will consider the complaint within the deadline 14 days from the date of its receipt. The Customer will be informed of the outcome of the complaint procedure via the same channel used to submit the complaint.

§ 8. Product Reviews (Compliance with the Digital Services Act)

The Seller allows Customers to post opinions about purchased Goods.

The Seller declares that it verifies whether the published opinions come from Customers who actually purchased the product. Verification is performed by checking whether the reviewer's email address is linked to their order history in the Store. Only verified customers can post a review.

It is prohibited to post content of an illegal nature, including opinions that are vulgar, offensive, misleading, infringing personal rights or constituting acts of unfair competition.

The Seller reserves the right to moderate or remove reviews that violate these Terms and Conditions. The author will be notified via email of any review deletion, along with the reason for the deletion.
§ 9. Personal Data Protection

The administrator of Customers' personal data is the Seller.

Personal data are processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

§ 10. Extrajudicial dispute resolution

The consumer has the option of using out-of-court complaint and redress procedures.

Detailed information on the possibility for the Consumer to use extrajudicial methods of complaint handling and redress as well as the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, and Provincial Inspectorates of Trade Inspection.

The consumer may also use the online dispute resolution platform (ODR platform), in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013. The platform is available at: http://ec.europa.eu/consumers/odr/.
§ 11. Final provisions

In matters not regulated in these Regulations, the generally applicable provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

All photos, graphics, logos, and content posted on the Store are the property of the Seller or have been used with the consent of their owners and are protected by copyright. They may not be copied or distributed without the Seller's consent.

The Seller reserves the right to make changes to the Terms and Conditions for important reasons (e.g., changes in legal regulations, changes in payment and delivery methods). These changes will not violate the acquired rights of Customers who placed orders before the changes came into effect.

The Seller will inform about any change to the Regulations at least 14 days in advance by publishing the new content on the Store's website.

The Regulations come into force on the date of their publication on the Store's website.
